By accessing or using the OneTouch platform ("Service"), you agree to be bound by these Terms of Service. These terms apply to all users, including administrators and anyone who accesses the platform.

We reserve the right to update these terms at any time. Continued use of the Service after changes are posted constitutes acceptance of the revised terms.

2 Description of Service

OneTouch is a multi-channel broadcast notification platform that enables organizations to send messages to their contacts via:

• KingsChat (via KingsChat API)
• WhatsApp (via Twilio)
• SMS (via Twilio)
• Email (via Brevo)
• Web Push Notifications (via OneSignal)

The Service includes contact management, broadcast scheduling, templates, and broadcast history.

3 Account Registration

To use OneTouch, you must create an account by providing accurate and complete information. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account
• Ensuring your account information remains accurate and up to date

We reserve the right to suspend or terminate accounts that provide false information or violate these terms.

4 Acceptable Use

You agree to use OneTouch only for lawful purposes. You must not use the Service to:

• Send spam, unsolicited messages, or bulk communications without consent
• Distribute malicious, harmful, offensive, or illegal content
• Impersonate another person or organisation
• Violate any applicable laws or regulations
• Attempt to gain unauthorised access to any part of the platform
• Interfere with or disrupt the Service or its infrastructure
• Upload contact lists obtained without proper consent

5 Contact Data & Consent

You are solely responsible for the contact data you upload to OneTouch. By uploading contacts, you confirm that:

• You have obtained valid consent from each contact to receive communications
• You comply with all applicable data protection and anti-spam laws
• You will promptly honour any opt-out or unsubscribe requests
• The data was collected lawfully and ethically

OneTouch accepts no liability for messages sent to contacts who have not consented to receive them.

6 Intellectual Property

The OneTouch platform, including its design, code, branding, and content, is owned by OneTouch and protected by applicable intellectual property laws.

You retain ownership of the content you create (messages, templates) and the contact data you upload. By using the Service, you grant OneTouch a limited licence to process your data solely for the purpose of delivering the Service.

7 Limitation of Liability

To the maximum extent permitted by law, OneTouch shall not be liable for:

• Undelivered or delayed messages due to third-party service failures
• Loss of data due to technical failures or force majeure events
• Any indirect, incidental, or consequential damages arising from use of the Service
• Actions taken by users in violation of these terms

The Service is provided "as is" without warranties of any kind, express or implied.

8 Termination

You may stop using OneTouch at any time. We reserve the right to suspend or terminate your account at our discretion if we determine you have violated these Terms of Service.

Upon termination, your access to the platform will be revoked and your data may be deleted after a retention period of 30 days.

9 Governing Law

These Terms of Service shall be governed by and construed in accordance with applicable law. Any disputes arising from the use of OneTouch shall be resolved through good-faith negotiation before any formal legal proceedings.
